Depends on what you mean by 'the same hardware'. They were using hardware with the same model numbers, but they were not using the same hardware, which is why the whole thing stunk to Dejo. He purchased two of anything that had the same model number, and had photographs of them side by side.

 

This post is not to drudge past issues up, and I have no dog in this fight, just wanted to clear up that point.

Though I will say that proof has been provided that raises suspicion. In a court of law it would be up to the accused to provide proof to rebut at this point.

 

Negative. In a court of law you are innocent until proven guilty. Its up to the prosecution to make its case with solid proof. Suspicion is as worthy as speculation in a court of law.

Whether there is enough evidence depends on the court here in the US.

If it's a criminal court you need proof beyond reasonable doubt. This fails.

If it's a civil court you need "clear and convincing evidence". This has data that is pretty clear and convincing to me, identical GPU clocks simply isn't going to happen down to the mhz, especially not at a speed that doesn't end in 0 or 5.

 

Of course, the good old i7 950 wp1024m rankings are the same way more or less, four guys from the same team within 1mhz of each other, and that was quietly swept under the rug.

 

 

This being the HWBot court, where it takes....... actually I don't know. If the ruling that was handed down to dejo/daughter was enforced this would be an open and shut case, as would the 950 rankings, and many others.

what we are failing to note here is that in smart doctor or any software for gtx-580's you dont choose the exact mhz you want to run. You are allowed within a range of numbers to either select the step below or above depending on which number you tried to input.

 

IE why 990mhz 964mhz 976mhz are popular frequencies for gtx-580's
